PAYMENT TERMS

New Clients, or those who have not placed an order with our Company in the last 12 months, are required to pay in advance via proforma invoice prior to the delivery of fabrics. The Vendor reserves the right to grant the Client a credit account.

ALL PROFORMA ACCOUNTS ARE STRICTLY NET

For special productions (including large quantity orders, discontinued fabrics, bespoke designs, or special treatments on fabrics), payment in advance is required.

In the event of non-payment after 30 days or a delay in taking delivery of ordered goods, the Vendor reserves the right to suspend further deliveries, terminate any supply contract, and require advance payment for any future orders. This shall be without liability to the Vendor for any consequential costs or damages and without prejudice to the Vendor’s rights in respect of goods already delivered.

Clients with a credit account will be reviewed every 12 months. If no business activity is recorded between the Client and the Vendor during this period, the account will be reverted to proforma payment terms.

Checks will not be accepted unless previously approved by the Vendor. If approved, an additional fee will be charged to the Client.

PRICES

All quoted prices are per linear metre, Ex Works Alicante, and exclude any applicable sales taxes or delivery charges. All prices apply to cut-length orders. At our discretion, additional discounts may be available for orders of a minimum of 50 metres or for display purposes (maximum 10 metres), subject to stock availability.

Prices are subject to change without prior notice. We recommend verifying the price at the time of order placement.

ORDERS

All orders must be confirmed in writing. The minimum order quantity is one linear metre, followed by increments of 10 centimetres. The minimum order value is €100 (excluding carriage costs). When placing an order, please ensure that the article and colour reference numbers are correct.

CARRIAGE

Carriage costs are additional and will be charged to the Client.

DELIVERY TIME

Normally 3 working days from receipt of order or payment, subject to stock availability, plus transit time to the place of delivery, unless delayed by circumstances beyond its reasonable control. The Vendor or its approved representative agrees to inform the Client of any delays or unavailability of goods within 3 working days.

RESALE OF GOODS

Resale of goods is not permitted without prior notification to the Vendor.

QUALITY AND PURPOSE

Goods are supplied within the standard limits of manufactured quality and in accordance with the specifications detailed in the Vendor’s sample literature. However, it is the Client’s responsibility to ensure the suitability of the goods for its specific purpose. Consequently, the Vendor makes no warranty regarding the fitness of the goods for that purpose.

OWNERSHIP OF GOODS

The goods supplied remain the property of the Vendor until full payment has been received.

LIABILITY

In the event of defects or delays in supply, the Vendor’s liability is limited to the invoice value of the goods and does not extend to any consequential costs or losses. In the case of a dispute, the laws of the Court of Alicante, Spain, shall apply.

Order cancellation policy

Our cancellation policy applies to cases where a client decides to change their mind after the order has been confirmed by Pepe Peñalver.

Pepe Peñalver does not accept order cancellations in the following circumstances:

  • When a new production has been initiated to fulfill the order.
  • Orders of 10 meters or less.
  • Velvet fabrics, regardless of the quantity ordered.
  • If the fabric has been altered, customised, or used for any finished or semi-finished products.

In all other cases not outlined above, Pepe Peñalver reserves the right to accept order cancellations at its discretion, provided the client agrees to select an alternative product from our collections. An order cancellation will only be considered accepted once Pepe Peñalver provides written confirmation to the client.

If an order cancellation is accepted after the goods have been dispatched, the finalisation of the cancellation agreement will depend on the condition of the returned fabrics (flaws, marks, quantity, colour, and quality) upon receipt at our warehouse in Alicante. The following procedure will apply:

  • The client is responsible for all transport costs to return the fabric(s) to our warehouse and must arrange delivery at their own expense.
  • Pepe Peñalver’s quality control department will inspect the condition of the returned fabrics. If the returned goods are found to have been used or damaged, the order cancellation will not be accepted under any circumstances. Pepe Peñalver will photographically document the condition of the returned goods upon receipt at our warehouse.
  • If the returned fabrics are approved by quality control, the client will be entitled to a refund of 75% of the invoice amount. All authorised returns are subject to a 25% restocking and administrative fee.

Claims policy

  • No claim will be accepted if the fabric has been manipulated or cut. Please check for correct colour, quality and quantity before handling or cutting, especially also in case of supply to a Third party.
  • All claims must be in writing and addressed to FABRIC EDITORS, S.A.U.
  • In cases where a claim has been accepted, goods will be replaced on availability.
  • When a claim is accepted, the goods will only be collected from the same delivery address where they were dispatched.
  • All claims must be made within 21 calendar days from receipt of goods and a sample may be required as evidence.
  • We do not guarantee an exact colour match to the sample book. If the colour match is important, please ask for a small cutting (CFA – Cut For Approval) in advance, or provide a sample or batch reference with the order and we will try to match the colour as close as possible.
  • No transport claim will be accepted if the damage has not been recorded in the delivery note by the recipient. Goods should be inspected by the transport agency at the time of the delivery, both inside and out of the packaging. Before signing any delivery note, we advise you to inspect the packaging for any visible signs of damage. We ensure the best packaging for all our products, paying particular attention with special packing procedures for velvets and sheers.
  • If the customer has overestimated the amount of fabric needed, a refund of the excess fabric will be accepted as long as the excess is equal or above to 10 meters, except velvets where no excess will be accepted on return. For care instructions please see label details.

The beauty of Pepe Peñalver fabrics lies in its large patterns. To ensure the best possible service, we recommend adding an additional repeat to your order. Please make sure you always state clearly the number of repeats that you need when placing your order.
